Tragic crash happened at about 6:15 p.m. on Highway 20/26 near Glenrock
GLENROCK, WY, (August 08, 2020) – Linda Flores, 64, sadly died in a motorcycle-car accident on Saturday, Aug. 8, on Highway 20/26 near Glenrock.
Ms. Flores was the passenger on a Harley Davidson westbound when the motorcycle crossed into oncoming traffic and struck an eastbound Cadillac at about 6:15 p.m.
Steering the motorcycle was James Conner, 54, who also sadly passed away. Both Ms. Flores and Mr. Conner were wearing helmets.
FATAL ACCIDENT INVESTIGATION NEEDED
Authorities are investigating the tragic accident. Driver inattention is being looked at as a contributing factor.
Candice Bond, Managing Partner at Bond Sanchez-Gordon, said in such cases that it’s important for a full independent investigation to be conducted by an experienced attorney. It allows victims and families of victims to negotiate with an insurance company on behalf of a client.
Bond, national analyst for The Legal Advocate, stressed that no amount of money will compensate for the tragic loss of a loved one. Still, it’s imperative that victims and families of victims are properly represented.
“Insurance companies often try to pressure victims and families of victims to settle for a quick payout for far less than the case is worth,” Bond added. “They are financially motivated to limit compensation and do not factor in the long-term consequences and suffering that a family will ultimately experience. Attorneys vigorously advocate for their clients to ensure that they are treated with respect and compensated fairly.”
Authorities and independent investigators will try to determine the potential factor(s) involved in the crash, including but not limited to impairment, fatigued driving, reckless driving, road conditions and speeding.
CONVERSE COUNTY WRONGFUL DEATH
Based on the information provided thus far, the family of Ms. Flores likely will be entitled to a wrongful death claim covering damages for funeral costs, loss of love and companionship, emotional trauma, and pain and suffering.
“A wrongful death claim is a civil action for financial damages brought by the estate or relatives of the deceased,’’ Bond said. “A civil case is very different from a criminal case in a number of ways and its own separate action. Criminal charges stem from law enforcement and pass through a prosecutor or a district attorney on behalf of the government where the remedy is a punishment against an individual who committed a crime.’’
“The passenger may also open a claim with the insurance company of the vehicle they were occupied in if their driver is held liable,’’ said Andrew Wright, Of Counsel with Bond Sanchez-Gordon. “This option has no impact on one’s own insurance policy since the claim is being made against an insurance policy that is not their own.”
