Accident was Saturday at Route 29A and McClure Road

SALISBURY, NY, (August 27, 2022) – A Whitesboro man was injured when an allegedly drunken driver crashed into his motorcycle in Herkimer County Saturday night.

Edward Olejarnik was badly injured when an allegedly drunken driver crashed into his motorcycle at Route 29A and McClure Road in Salisbury Saturday night.

According to a New York State Police report, the accident occurred around 8:12 p.m. when a 21-year-old Dolgeville woman driving a 2017 Volkswagen east on State Route 29A  failed to yield to a 2014 Harley Davidson motorcycle as she attempted to turn onto McClure road.

The Harley driver, Edward J. Olejarnik, 52, sustained severe injuries in the collision. He was airlifted to Upstate University Hospital, where he is listed in serious condition.

Olejarnik’s 5-year-old female passenger was taken by ambulance to St. Elizabeth’s Hospital with non-life-threatening injuries.

The driver of the Volkswagen was arrested and charged with driving while intoxicated and second-degree vehicular assault. She was arraigned and released on her own recognizance

Despite crackdowns throughout this country, impaired drivers remain a threat to innocent, law-abiding victims.

The consumption of alcohol can diminish the ability to operate a motor vehicle. According to Mothers Against Drunk Driving, each year about 300,000 people are injured in the U.S. by drunken drivers.

An independent investigation will be required to learn other potential factors in the case such as blood-alcohol content levels.

Candice Bond, an experienced DUI accident attorney, was interviewed and provided her thoughts on incidents such as this.

“Separate from criminal charges, a victim may be entitled to compensation through a civil lawsuit against the responsible party, said Candice Bond, Managing Partner of Bond Legal. “In addition to the diligent work of law enforcement, an attorney can re-interview important witnesses, analyze any surveillance video from the scene of the crash, and obtain phone and texting records of the liable party. Serving as an advocate, an attorney can help compassionately guide an injured victim during this difficult time, protecting their legal rights, while ensuring that a driver who takes the wheel under the influence is held accountable for their actions.”

Pending the results of the investigation, Edward Olejarnik may have the right to pursue a personal injury lawsuit. The stress and worry following a serious injury can be overwhelming, disrupting all aspects of life, including family, work, finances, and overall quality of life.

“Insurance companies often try to pressure victims to settle for a quick payout for far less than the case is worth,” said Candice Bond, Managing Partner of Bond Legal. “They are financially motivated to limit compensation and do not factor in the long-term consequences and suffering that a victim will ultimately experience. Attorneys vigorously advocate for their clients to ensure that they are treated with respect and compensated fairly.”
